He uses that claim as justification to halt payments to the tribe.

FERC

The OEP [Office of Energy Projects] Director, on a case-by-case basis, will establish deadlines and coordinate federal and state actions for all federal authorizations necessary for proposed natural gas projects under section 3 and section 7 of the Natural Gas Act.

[WEBMASTER'S COMMENT: In other words, there will be no rules or guidelines other than the OEP Director's subjective judgement.]

[T]he Commission today increased the cost caps for projects that may be constructed under the automatic authorization provisions of Part 157, Subpart F blanket certificate regulations from $8 million to $16 million, and under the prior notice provisions from $22 million to $50 million. The increased limits will apply to projects providing increased or alternative access to natural gas supplies. The regulations implement provisions of the Natural Gas Act. In addition, the Commission is temporarily expanding the definition of “eligible facilities” that can be constructed under the blanket certificates.

[WEBMASTER'S COMMENT: FERC, whose commission members already have close ties to the industries that they regulate, now has an Administrative Law Judge who used to work for a company that he now regulates. Is there any wonder why the public believes that FERC represents the the energy industry?]
